All users of mSpy are required to accept all terms on this page along with the User Legal Agreement when creating your account and upon purchase.
This policy outlines the privacy practices of mSpy (www.mspy.com) and it applies solely to information collected by the mSpy website. It establishes the following:
- What personally identifiable information is collected from you through the web site; how it is used; and with whom it may be shared.
- Choices available to you regarding the use of your data.
- Security procedures in place to protect against the misuse of your information.
- How you can rectify any inaccuracies you may find in the information.
Information Collection, Use, and Sharing
mSpy is the sole owners of the information collected on this site and we only have access to or collect information that you voluntarily give us via email or through other direct contact from you. mSpy will not sell or rent this information to any other entity and it is solely for our own use.
mSpy will use the information you have provided in order to respond to you, in regards to the reason you contacted us. mSpy will not share your information with any third party outside of our organization, other than when necessary to fulfill your request, e.g. to complete shipment of an order.
It is necessary for mSpy to request personal information from you on our order form. In order to purchase our software products from us, you must provide contact information (such as your name and shipping address) and financial information (such as credit card number, expiration date). This information is used for billing purposes only and to fill your order. If we have any problem with the processing of your order, we will use this information for the purpose of contacting you.
Your Access To And Control Over Information
You may opt out of any future contact from us at any time you choose. You can do the following at any time by contacting us via the email address or phone number provided on our web site:
- See what data we may have about you, if any.
- Change/correct any data we may be in possession of related to you.
- Request that we delete any data we have about you.
- Express any concern you have about our use of your personal data.
We take all reasonable precautions to protect the privacy of your information. When you submit sensitive information via the mSpy website, your information is protected online as well as offline.
Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by the presence of a closed lock icon at the bottom of your web browser, or seeing the letters "https" at the beginning of the URL address of the web page.
While we employ the use of encryption to protect sensitive information transmitted online, we also provide protection of your information offline. Only employees who require the information to perform a specific job (such as for billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store your personally identifiable information are maintained in a secure environment.
This policy governs your purchase of mSpy - the smartphone monitoring application. Please read it carefully before finishing your order as it sets out your rights in relation to your purchases, including important limitations and exclusions. Your placement of an order constitutes your agreement that your order is governed by this policy.
If you are not fully satisfied with your purchase of the software and services, you can get your money back upon the terms and conditions set forth below. However, we believe that most of refunds can be avoided if you get professional from our experts.
You have the unconditional right to claim and receive a full refund for the software within 10 days following the day of your purchase.
No refund will be available after this refund period is over.
The refund may apply only to the primary (first) mSpy subscription.
If you own more than one subscription, no refund will be available.
Your money may be refunded only once. If you buy another mSpy subscription at a later time, this will not be subject to a refund request.
Any purchase of the software at a discount price is non-refundable.
No refund is due if the customer refuses to upgrade the mSpy version in the event of performed upgrade on the target phone.
No refund shall be granted in case you provide the reasons that are beyond our control. Those are:
- The target phone fails to connect to the Internet (the target phone account has run out of money, it is beyond services area, roaming-related issue etc).
- A target user switches the carrier on the phone and this may result in putting restrictions on the internet connectivity, consequently bad mSpy functioning.
- OS update.
- Restoring to factory settings.
- A customer refuses to let the customer support team to walk him/her through the installation process denying the obvious facts of the download simplicity.
- Personal reasons ('I don't need it any more',' I changed my mind', and the like)
- Customer does not have physical access to the phone (Customers are made aware by the information outlined on this website that unrestricted physical access to the phone -the customer wishes to spy on- is required. If a customer purchases this software and does not have unrestricted access (including locks, passcodes, etc.) to the phone to be monitored, we are not liable for refunds due to this case.)
- A customer is either unable or unwilling to jailbreak their iPhone.
All refund requests must be submitted to our Customer Help team at email@example.com. Requests made via a Live Chat, or by phone are not acceptable. The decision about whether to grant a return request is made within one or two business days. In case of a dispute you will have to provide strong reasons, examples to back up your claim.
For all orders that are placed on Dispute status, you have 14 days period to resolve the situation with the Customer Support Manager. If you fail to provide required information or feedback within time provided, dispute will be automatically closed.
Failure to provide the information required for dispute resolution within 14 days will result in annulment of the dispute and no refund will be possible thereafter.
SOFTWARE END USER LICENSING AGREEMENT (EULA)
PLEASE CAREFULLY REVIEW THIS LICENSING AGREEMENT PRIOR TO PURCHASING OR USING THE MSPY SOFTWARE. BY PURCHASING AND USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, DO NOT INSTALL OR USE THE SOFTWARE AND DELETE THE SOFTWARE AND ALL OF ITS RELATED FILES FROM YOUR DEVICE.
This mobile device software, artwork, sound, and additional components included in this product (collectively referred to herein as the "Software") are the copyrighted property of mSpy and its licensing agents (collectively referred to as "mSpy”). This Software is licensed (not sold) to you, and mSpy owns and retains all copyrights, trade secrets, patents and all other proprietary rights included in the Software. You are licensed to use the Software on a single device. You may not: (1) copy (other than being in possession of one copy for backup purposes), distribute, rent, lease or sub-license all or any portion of the Software; (2) change, modify or prepare derivative works of the Software; (3) transmit the Software over a network, by telephone or electronically using any means; (4) reverse-engineer, disassemble or de-compile the Software.
You have the right to transfer the Software, but only if the recipient agrees to accept these terms and conditions outlined in this End User Licensing Agreement. In the event that you do transfer this Software, your license is automatically terminated and you are required to transfer all components, documentation and related files to the transferee while erasing any copies existing on a device onto which the software resides or has been installed by you.
You acknowledge and agree that the use of this Software is at your sole risk with the exception of the following 90-day limited, non-transferable warranty on the product:
mSpy agrees to warrant the original purchaser that the Software will be free from defects in material and workmanship under normal use for a period of 90 days from the date of purchase. If the Software proves to be defective, mSpy will replace the defective digital media free of charge to the purchaser, provided that the digital media proves to be defective within the 90-day period following the date of purchase.
The terms of this EULA are subject to change at any time, and in the event of any changes, the updated version of the licensing agreement will appear on this page.
